1. Acceptance of Terms

By accessing or using FirstImpression ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must:

  • Be at least 16 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and truthful information
  • Not be prohibited from using the Platform under applicable law

3. User Accounts

3.1 Account Types

We offer two account types:

  • Candidate Accounts: For job seekers looking for opportunities
  • Company Accounts: For employers posting jobs and reviewing applications

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Harm other users or the Platform
  • Remain inactive for extended periods

4. User Content and Conduct

4.1 Your Content

You retain ownership of content you submit (videos, resumes, profiles). By submitting content, you grant us:

  • A worldwide, non-exclusive license to use, store, and display your content
  • The right to process your content with AI for matching and analysis
  • Permission to share your content with companies you apply to

4.2 Prohibited Content

You may not submit content that:

  • Is false, misleading, or fraudulent
  • Infringes on intellectual property rights
  • Contains hate speech, harassment, or discrimination
  • Includes sexually explicit or violent material
  • Violates privacy or data protection laws
  • Contains malware or malicious code

4.3 Prohibited Conduct

You may not:

  • Scrape or automatically extract data from the Platform
  • Impersonate others or misrepresent your identity
  • Interfere with Platform security or operations
  • Use the Platform for spam or unsolicited communications
  • Circumvent access controls or restrictions

5. Video Recording and AI Analysis

5.1 Consent to Recording

By recording videos on the Platform, you consent to:

  • Video and audio recording through your device
  • Storage of your videos on our secure servers
  • Sharing videos with companies when you apply to jobs

5.2 AI Analysis

You consent to AI-powered analysis of your videos, including:

  • Automatic transcription of audio
  • Skills detection and extraction
  • Communication quality assessment
  • Match score calculation

5.3 Accuracy

While we strive for accuracy, AI analysis may not be perfect. Companies should use AI insights as one factor among many in their hiring decisions.

6. Company Responsibilities

Companies using the Platform agree to:

  • Comply with all applicable employment and anti-discrimination laws
  • Use candidate data only for legitimate hiring purposes
  • Maintain confidentiality of candidate information
  • Not download or store candidate videos outside the Platform without permission
  • Provide accurate job descriptions and requirements
  • Respond to applications in a timely manner

7. Intellectual Property

7.1 Our IP

The Platform, including its design, features, and functionality, is owned by FirstImpression and protected by copyright, trademark, and other laws.

7.2 Your IP

You retain all rights to your content. We only use your content as described in these Terms and our Privacy Policy.

8. Disclaimers and Limitations

8.1 No Guarantee of Results

We do not guarantee:

  • That you will find a job through the Platform (candidates)
  • That you will find suitable candidates (companies)
  • The accuracy of match scores or AI analysis
  • Uninterrupted or error-free service

8.2 Third-Party Services

We use third-party services (e.g., AI providers, cloud storage). We are not responsible for their actions or failures.

8.3 "AS IS" Basis

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRSTIMPRESSION SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your use of the Platform
  • Actions or omissions of other users

Our total liability shall not exceed the amount you paid us in the past 12 months, or €100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless FirstImpression from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your content or conduct on the Platform
  • Your violation of any laws or third-party rights

11. Data Protection and Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes shall be resolved through:

  1. Good faith negotiations between the parties
  2. If unresolved, mediation
  3. If still unresolved, the courts of Portugal

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
